SUNSWEAT — Strength in Every Season

Terms of Service

Effective Date: 8/31/2026 | Last Updated: 8/31/2026

Welcome to SUNSWEAT. These Terms of Service (“Terms”) govern your use of the SUNSWEAT website, app, studio, classes, memberships, class packs, introductory offers, drop-in classes, and related services.

By creating a SUNSWEAT account, purchasing or booking a service, attending a class, or otherwise using SUNSWEAT services, you agree to these Terms and any applicable policies or agreements referenced below.

1. Memberships & Purchases

SUNSWEAT offers memberships, class packs, introductory offers, drop-in classes, and other services. Pricing, benefits, class limits, expiration dates, promotional terms, and other purchase-specific details are those displayed and accepted at the time of purchase.

All SUNSWEAT memberships are month-to-month unless otherwise stated and have no long-term commitment.

Memberships, class packs, drop-ins, introductory offers, and other purchased services are personal to the account holder and may not be shared, transferred, resold, or exchanged for cash or account credit unless SUNSWEAT expressly authorizes otherwise.

2. Membership Billing, Cancellation & Pauses

Recurring memberships automatically renew each month on the original billing date until canceled.

Members are responsible for maintaining a valid payment method and for all authorized charges. If a payment fails or an account has an outstanding balance, SUNSWEAT may restrict class booking, membership benefits, or access to services until the balance is resolved.

Memberships may be canceled through the SUNSWEAT app at any time. Cancellation takes effect at the end of the current billing period, and the membership will not renew for the following billing period. No partial-month refunds are provided.

Founding membership rates remain locked while the founding membership remains active. If a founding membership is canceled, the founding rate is forfeited and cannot be reinstated.

SUNSWEAT may permit temporary membership pauses. Pause requests must be submitted in advance and are not retroactive. During an approved pause, membership billing and class access are suspended and automatically resume when the approved pause ends. Additional pause requirements may apply.

3. Class Booking, Cancellation & No-Shows

Classes must be reserved in advance through the SUNSWEAT app or designated booking platform. Each reservation is personal to the client and reserves a limited space in class.

Clients must cancel at least 6 hours before the scheduled class start time to avoid a late-cancellation penalty.

For cancellations made less than 6 hours before class or for no-shows:

  • All-Access Members: A $10 late-cancellation or no-show fee applies.
  • Momentum 8 & Essential 4 Members: One class credit is forfeited.
  • 10-Class Pack & Drop-In Clients: One class credit is forfeited.

Applicable fees may be charged to the payment method on file. Frequent late cancellations or no-shows may result in temporary booking restrictions.

4. Class Attendance & Studio Policies

Clients should arrive 10–15 minutes before class to check in and prepare. SUNSWEAT doors open 15 minutes before each class and close promptly at the scheduled class start time.

Late arrivals cannot be accommodated once class has begun. This policy is intended to support the safety, comfort, and experience of everyone in the studio.

Clients agree to:

  • Follow instructor directions and posted safety policies.
  • Use studio equipment appropriately and return it after use.
  • Wipe down equipment and their mat area after class.
  • Silence and store phones during class.
  • Respect other clients, staff, instructors, and the studio environment.
  • Notify their coach before class of any injury, limitation, or need for modification.
  • Follow all applicable studio rules and safety instructions.

SUNSWEAT may refuse or limit access to a class or the studio when reasonably necessary for safety, capacity, conduct, or operational reasons.

5. Health, Safety & Liability

SUNSWEAT classes may include strength training, resistance training, cardiovascular conditioning, heated exercise, Pilates-inspired movement, weights, dynamic movement, and other physical activities.

Participation in physical activity and heated exercise involves inherent risks. Clients should consider their individual health and fitness circumstances and consult a qualified healthcare professional when appropriate.

Clients must communicate relevant health limitations, injuries, or restrictions to SUNSWEAT staff or instructors before participating.

A separate SUNSWEAT Liability Waiver & Release Agreement may be required before participation. The Liability Waiver & Release is a separate agreement and is not replaced or modified by these Terms.

6. Payments, Refunds & Expiration

Except where required by applicable law or expressly stated in the applicable purchase terms, memberships, classes, class packs, drop-ins, introductory offers, and other purchases are non-refundable once processed.

Unused or expired class credits are not refundable, transferable, extendable, or convertible to cash or account credit.

Retail, merchandise, and other in-studio purchases are final sale unless otherwise required by law.

Class packs and promotional offers are subject to the expiration and eligibility terms disclosed at the time of purchase.

7. Accounts, Guests & Minors

Each client must maintain their own SUNSWEAT account. Clients may not book under another person’s account or use another person’s membership or class credits.

Where a membership includes a guest pass, the guest must create their own SUNSWEAT account and complete all required registration and waiver requirements before participating.

SUNSWEAT may permit minors to participate in certain services. A parent or legal guardian must provide any required consent, agreements, and waivers and is responsible for ensuring that the minor follows studio rules and instructor directions.

8. Photography, Video & Intellectual Property

SUNSWEAT may photograph or record classes, events, and studio activities for marketing, advertising, social media, website content, promotional materials, and other business communications.

Where separate consent or a release is required, that consent or release will govern the use of an individual’s photograph, image, likeness, voice, or appearance.

SUNSWEAT’s name, logos, branding, photographs, videos, written content, class descriptions, programming materials, Signature Method, and other original content are owned by or licensed to SUNSWEAT and may not be copied, reproduced, distributed, or used commercially without written permission.

9. Website, App & Third-Party Services

SUNSWEAT uses third-party services, including Mariana Tek for certain account management, membership, class scheduling, booking, attendance, and related services, and third-party payment processors such as Stripe.

Use of third-party platforms may also be subject to their own terms, privacy policies, and security practices. SUNSWEAT is not responsible for services or policies outside of its reasonable control.

Clients are responsible for providing accurate account information and maintaining the security of their account credentials.

10. Changes & Service Availability

SUNSWEAT may modify class schedules, instructors, class formats, programming, equipment, class duration, room conditions, or other aspects of its services.

Classes or services may occasionally be canceled, modified, or interrupted because of instructor availability, maintenance, weather, emergencies, operational issues, building conditions, or circumstances beyond SUNSWEAT’s reasonable control.

When reasonably possible, SUNSWEAT will provide notice of material changes or cancellations.

Nothing in these Terms limits any cancellation, refund, or other rights that cannot legally be waived under applicable law.

11. Privacy & Communications

SUNSWEAT’s collection and use of personal information is governed by the SUNSWEAT Privacy Policy, which is incorporated into these Terms by reference.

SUNSWEAT may send necessary communications regarding memberships, payments, bookings, reminders, schedule changes, account matters, customer service, and studio operations.

Where permitted by law and with any required consent, SUNSWEAT may also send promotional email or text messages. Marketing communications may be unsubscribed from using the instructions provided in those communications. Opting out of marketing communications does not prevent necessary transactional or account-related communications.

12. Suspension, Termination & General Terms

SUNSWEAT may suspend or terminate access to its services for nonpayment, violation of these Terms or studio policies, unsafe or abusive conduct, misuse of property or equipment, fraudulent activity, or other circumstances permitted by law.

These Terms, together with applicable purchase or membership terms, the SUNSWEAT Privacy Policy, Liability Waiver & Release Agreement, and other policies expressly incorporated into these Terms, constitute the agreement governing your use of SUNSWEAT services.

If a specific membership or purchase agreement conflicts with these Terms, the specific agreement will control for that transaction unless applicable law provides otherwise.

These Terms are governed by the laws of the State of Ohio, except where applicable law requires otherwise. If any provision is found unenforceable, the remaining provisions will remain in effect.

SUNSWEAT may update these Terms from time to time to reflect changes in its services, policies, business practices, or applicable law. The most current version will be made available through the SUNSWEAT website, app, booking platform, or other designated location.

By creating an account, purchasing or booking a service, attending a class, or otherwise using SUNSWEAT services, you acknowledge that you have read, understood, and agreed to these Terms.
